New Guidance on Executive Order 192New Jersey Realtors® received guidance from the governor's office regarding Executive Order 192, which took effect this morning at 6 a.m. The EO mandates employers follow health and safety standards to protect all New Jersey’s workers at work during the pandemic.

The EO does not apply to independent contractors that have 1099 status. However, at open houses, sanitation materials must be provided to visitors. Open house visitors are required to wear cloth or disposable face masks while on the premises, in accordance with Centers for Disease Control and Prevention recommendations. There are exceptions including for children under the age of 2 and individuals with certain disabilities. Please see EO 192 for details.

Employers must follow health and safety practices such as requiring six feet be maintained between individuals, requiring masks be worn, providing sanitation materials, regularly washing hands, routinely disinfecting high touch areas, and conducting daily health checks. LoveLettersorLiabilityLettersBuyer “love” letters are a tactic used by some buyers in an attempt to stand out to a seller, especially in hot markets with low inventory and bidding wars.  Seemingly harmless, these letters actually raise fair housing concerns, and could open real estate professionals and their clients to fair housing violations.  Learn how to protect yourself and your clients from the potential liability related to buyer letters.

To entice a seller to choose their offer, buyers sometimes write letters to describe the many reasons why the seller should “pick them.”  While this may seem harmless, these letters can actually pose fair housing risks because they often contain personal information and reveal characteristics of the buyer, such as race, religion, or familial status, which could then be used, knowingly or through unconscious bias, as an unlawful basis for a seller’s decision to accept or reject an offer.

If you plan to mail your ballot it must be completed and postmarked on or before Nov. 3, and received by Nov. 10 at 8 p.m. You can also deliver your completed ballot to your county board of elections office, or bring it to your polling location on Nov. 3.

Executive Order 192On Tuesday, October 27, 2020 Governor Murphy signed Executive Order 192, which mandates private and public companies to implement uniform health and safety standards protecting all workers.  This order will go into effect on Thursday, November 5, 6:00 am and requires the following:

  • Workers maintain at least six feet of distance from one another to the maximum extent possible. 
  • Employees, customers, visitors, and other individuals entering the worksite to wear cloth or disposable face masks while on the premises, with limited exceptions.
  • Employers must make available, at their expense, such face masks to their employees.  
  • Companies provide workers, customers, and visitors with sanitizing materials, such as hand sanitizer that contains at least 60% alcohol and sanitizing wipes, at no cost to those individuals.
  • Companies ensure that employees practice regular hand hygiene, particularly when such employees are interacting with the public, and provide employees break time for repeated hand washing throughout the workday and access to adequate hand washing facilities.
